JLT Gardening – Residential Client Terms & Conditions
These Terms and Conditions apply to all residential gardening and maintenance services provided by JLT Gardening (ABN: 98556423258), hereafter referred to as “JLT”.
1. Definitions

“Client” refers to the homeowner, tenant, or authorised resident engaging JLT.

“Services” means all gardening, lawn care, hedge trimming, green waste removal, and general residential maintenance services.

“Agreement” refers to these Terms and Conditions and any written quotation or service plan.
2. Quotes and Pricing

Quotes are valid for 30 days.

Pricing may change if site conditions differ from what was originally described or if additional work is required.

Any changes to the agreed scope must be approved in writing.
3. Invoicing and Payment

Invoices are issued upon completion of the service unless otherwise agreed.

Payment is due on the day of service.

Late payments incur a 5% monthly fee. Continued non‑payment may be referred to a third‑party collection agency at the client’s cost.

JLT may pause or cancel future bookings for overdue accounts.
4. Cancellations and Rescheduling

Minimum 24 hours’ notice is required.

Late cancellations may incur a fee of up to 50% of the service cost.

JLT may reschedule due to unsafe weather or conditions without penalty.
5. Access and Site Conditions

Clients must ensure:

Unlocked gates
-
Pets secured
-
Clear access to all work areas

Excessively cluttered or unsafe areas may incur additional charges.
6. Safety and Compliance
-
JLT complies with all OHS requirements.

Work will cease if conditions are unsafe (e.g., aggressive pets, hazards, unstable structures).
7. Damage and Liability

JLT is not liable for damage to concealed infrastructure unless identified in writing beforehand.

Accidental damage caused by JLT will be managed through our insurance process.
8. Green Waste and Rubbish Removal

Standard services include removal of minor green waste.
-
Large volumes, hard rubbish, or landfill waste may incur additional disposal fees.
9. Ongoing Maintenance Plans
-
Services occur at agreed intervals (weekly, fortnightly, monthly).
-
Pricing may be adjusted due to fuel costs, inflation, or changes in property condition.
10. Client Property and Equipment
-
JLT will not use client‑owned tools or machinery.
-
JLT is not responsible for damage to or caused by client equipment.
11. Termination
-
Either party may terminate ongoing services with 14 days’ written notice.

All outstanding payments must be settled before the final service.
12. Intellectual Property

Any designs, plans, or recommendations remain the property of JLT unless agreed otherwise.
13. Force Majeure
-
JLT is not liable for delays caused by events outside our control.
14. Governing Law
-
These Terms are governed by the laws of Victoria, Australia.
15. Acceptance
By engaging JLT, the client agrees to these Terms and Conditions.

These Terms and Conditions apply to all commercial, industrial, strata, and body‑corporate services provided by JLT Gardening (ABN: 98556423258), hereafter referred to as “JLT”.
1. Definitions

“Client” refers to the business, organisation, property manager, body corporate, or authorised representative engaging JLT.

“Services” include commercial grounds maintenance, landscaping, lawn care, waste removal, and scheduled property upkeep.

“Agreement” includes these Terms, any service contract, maintenance schedule, or written quotation.
2. Quotes and Pricing

Quotes are valid for 30 days.

Pricing may vary based on site inspections, safety requirements, or changes in scope.

Variations must be approved in writing by an authorised representative.
3. Invoicing and Payment

Invoices are issued according to the agreed billing cycle (e.g., per visit, fortnightly, monthly).

Payment terms are strictly 14 days unless otherwise stated in the service agreement.

Late payments incur a 5% monthly fee and may be referred to a third‑party collection agency at the client’s cost.

JLT may suspend services for overdue accounts.
4. Cancellations and Rescheduling

Minimum 48 hours’ notice is required for commercial bookings.

Late cancellations may incur up to 100% of the scheduled service fee, depending on labour and equipment allocated.

JLT may reschedule due to unsafe weather or site conditions.
5. Access and Site Conditions

The client must ensure:

Safe and unrestricted access to all areas

Compliance with site induction requirements

Notification of security procedures or restricted zones

Delays caused by access issues may incur additional charges.
6. Safety and Compliance
-
JLT adheres to all OHS and WorkSafe Victoria requirements.
-
Site‑specific safety documentation (SWMS, JSA, inductions) can be provided upon request.
-
Work will cease if conditions are unsafe or non‑compliant.
7. Damage and Liability
-
JLT is not liable for damage to concealed infrastructure unless identified in writing prior to work.

Accidental damage caused by JLT will be managed through our insurance process.

The client is responsible for ensuring the site complies with safety standards.
8. Waste Removal
-
Commercial waste removal (green waste, hard rubbish, bulk disposal) may incur additional fees.
-
Fees are based on volume, weight, and disposal facility charges.
9. Scheduled Maintenance Contracts

Services are performed at agreed intervals as per the maintenance plan.
-
Pricing may be reviewed periodically based on fuel costs, inflation, labour requirements, or changes in property condition.

Missed visits due to client‑caused access issues may still be billable.
10. Client Property, Equipment & Compliance

JLT will not use client‑owned machinery unless formally agreed in writing.

JLT is not responsible for damage to or caused by client equipment.
-
The client must ensure compliance with all site‑specific policies.
11. Termination

Either party may terminate the agreement with 30 days’ written notice.

All outstanding invoices must be paid before the final service.
12. Intellectual Property

All designs, plans, reports, or documentation created by JLT remain JLT’s intellectual property unless otherwise agreed.
